Nativ Collection Pty Ltd ACN 680 325 704 (“we”, “us”, “our”, “Nativ Collection”) is committed to protecting your privacy. This Privacy Policy is intended to explain how we and our related entities will collect and protect your privacy and should be read in conjunction with our Terms of Use.

We may in the course of providing our services to you be required to collect your personal, sensitive, credit, and confidential information.  

We will always act in accordance with the Privacy Act 1988 (Cth) (“Privacy Act”) and the Australian Privacy Principles (“APPs”) when dealing with your personal information. We are also subject to the Privacy (Credit Reporting) Code 2014 (“Privacy Code”) in relation to our management of credit information.

COLLECTION OF INFORMATION

Personal information covered under this Privacy Policy
This Privacy Policy covers your personal information. Personal information is information or an opinion, whether true or not, and whether recorded in a material form or not, about an identified individual, or an individual who is reasonably identifiable. All personal information received in connection with Nativ Collection is subject to strict rules of confidentiality.

Personal information we may collect from you
We may collect some or all of the following types of personal information:

  • information that you give us through your dealings with us;
  • information that we may collect from you; and
  • information that we may receive from you from other third-party sources.

This information may include, amongst other things:

  • your name;
  • your contact details, including email address, mailing address, street address and/or telephone number;
  • your age and/or date of birth;
  • your credit card details;
  • your demographic information, such as postcode;
  • your preferences and/or opinions;
  • information you provide to us through customer surveys, feedback, testimonials, etc.;
  • your browser session and geo-location data, device and network information, statistics on page views and sessions, acquisition sources, search queries and/or browsing behaviour;
  • information about your access and use of our Website, including through the use of internet cookies, your communications with our Website, the type of browser you are using, the type of operating system you are using and the domain name of your internet service provider;
  • additional personal information that you provide to us, directly or indirectly, through your use of our Website, associated applications, associated social media platforms and/or accounts from which you permit us to collect information; and
  • any other personal information requested by us and/or provided by you or a third party.

By agreeing to this Privacy Policy, you consent to the fact that you are aware that we are collecting your personal information and disclosing it as required by us and in accordance with the Privacy Act and any applicable APPs.

“Personal information” is data that identifies, relates to, describes, can be used to contact, or could reasonably be linked directly or indirectly to you. For the purposes of this Privacy Policy, there is no meaningful distinction between the terms “personal information” and “personal data.”

You may choose not to provide some of the personal information described above. Please note, however, that some of our services require some personal information to operate, so if you choose not to provide the personal information necessary to operate and provide you with a particular service or feature of that service, you may not be able to use that service or feature. 

Information that you give us
We may collect your personal information directly from our contact with you. This may include by you completing forms or parts of our application, or by you contacting us via email, telephone, through social media and other similar functions either directly through our Website or through third-party host sites, in person, through various marketing channels or competitions either directly through our Website or through third-party host sites, and surveys.

You understand that any personal information that you provide to us must be accurate and up to date. We will assume this to be the case. Your failure to comply with this obligation may impact on our ability to provide you with goods and services.

Information that we collect about you
Our Website may automatically collect the following information about you each time you visit our Website: 

  • technical information including but not limited to the Internet Protocol Address used to connect your computer to the internet, the internet browser and version that you are using when accessing our Website, any additional plug-ins that you are using, and your computer’s operating system and platform; and
  • information about the time and date you accessed on our Website, and what you accessed on our Website. This includes links that you clicked on, what content you accessed, how long you accessed that content for, whether you downloaded any content, whether supplied by us or downloaded from a third-party host, and how you navigated to and from our Website to other sites or other pages hosted by us.

You consent to the disclosure of your personal information to any of our related entities.

You consent to our collection of your personal information and disclosing it to third parties where necessary and for the purposes for which it was collected. This may include:

  • using your personal information to provide you with information that you have requested from us;
  • using your personal information and providing it to third parties to assist with the provision of goods and services to you;
  • authenticating your credit or debit card account information;
  • using your personal information for marketing purposes to provide or offer services to you. This includes our direct marketing to you or another third party whom you have authorised us to disclose your personal information to;
  • to notify you about any changes to our product, Website, brand, or goods and services offered;
  • to seek your opinion and feedback on any of our goods and services, including for the purposes of improvement and customisation, Website improvement and personalisation and other general services;
  • for user engagement and/or customer service purposes, including but not limited to identifying the effectiveness of advertising, allowing you to participate on Website viral features such as sharing Website content and other community features (e.g., blogs);
  • for other general services such as Website security, maintenance, identification of fraud or errors, internal accounting and administration, and for any other purpose that we are required or permitted to do by law; and
  • to manage our relationships with you and our other customers.

Professional obligations to disclose
We may be required to disclose your personal information for the purposes for which it was collected and also subject to our legal obligations:

  • to any person where necessary or desirable in connection with our provision of services; and
  • on a confidential basis to our external service providers and advisors.

To be clear, you consent to our disclosure of your personal information to any of our business partners, supplies, sub-contractors or the like, advertisers and other advertising networks, analytics, and search engine providers and other third parties provided the disclosure of your personal information is for the purpose or ancillary to the services that we or these third parties offer you and for the purposes the information was originally collected.

You understand that we are authorised to disclose your personal information to third parties in the event that we buy or sell any business or assets, including our business, if we are under a duty to disclose your information, or if the disclosure of your personal information is necessary for us to conduct an investigation into any unlawful activity that we know, or suspect has or may be engaged in.

You consent to the disclosure of your personal information to overseas recipients and warrant that you are aware that an overseas recipient of your personal information is not required to comply with the Privacy Act or the APPs. Please notify us immediately if you have any objections to us providing your personal information to any overseas recipient.

You consent to the disclosure of all information necessary for us to comply with any relevant reporting obligations (if any) pursuant to the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (Cth).

We will endeavour to take all reasonable steps to ensure that any overseas recipient of your personal information does not willingly or knowingly breach the APPs in relation to your personal information.

How we store your personal information 
We are committed to ensuring that the personal information we collect is secure and we will endeavour to take all reasonable steps to store your personal information securely.

Once we receive your information, we take reasonable steps to protect your personal information. This may include storing any information on a secure server and employing strict procedures and security features to protect your personal information from any unauthorised recipients and to prevent unauthorised access to the same. We may also store your personal information in physical form. 

All our employees with access to your information will be held to the confidentiality obligations as set out in this Privacy Policy.

We will only keep your information for as long as reasonably necessary to fulfil the purposes for which your personal information was originally collected. We will delete your information after a reasonable time. You may be required to re-enter your personal information if it has been deleted.

You agree and acknowledge that your personal information may be stored at or transferred within Australia or a destination outside of Australia.

We will take all reasonable steps and precautions to ensure that any transmission of your personal information via the internet is secure. However, we cannot guarantee the security of any data transmitted to our Website and you agree and acknowledge that any such transmissions are at your own risk.

We may use cookies on our Website from time to time. Cookies are text files placed in your computer’s browser to store your preferences. Cookies, by themselves, do not tell us your email address or other personally identifiable information. However, they do allow third parties, such as Google and Facebook, to cause our advertisements to appear on your social media and online media feeds as part of our retargeting campaigns.

If and when you choose to provide our Website with personal information, this information may be linked to the data stored in the cookie. If you enabled cookies when accessing our Website, we will take this as consent to our use of cookies and other technologies mentioned in our Privacy Policy.

Links to other websites
Our Website may contain links to other websites. We do not have any control over those websites, and we are not responsible for the protection and privacy of any personal information which you provide whilst visiting those websites. Those websites are not governed by this Privacy Policy. 

Your rights
You have the right to request access to the personal information we hold about you by contacting us.

If we cannot provide you with access, we will write to you and provide you with the reasons why we are unable to provide you with access. 
If any personal information that we hold about you is inaccurate, incomplete, or not up to date, you may write to us and request that we correct the information at the above address.

You have the right to request that we do not disclose your personal information (for example, for marketing purposes). You can exercise your rights by unchecking the relevant check boxes on our Website when you provide us with your personal information, or by writing to us.

Frequently asked questions

What if I reach my weekly download limit of assets and need more?

You can upgrade your subscription at any time to allow more downloads or you can purchase single assets as you need.

Can I share my downloaded assets with a friend or colleague?

This depends on your level of subscription. For non-subscribers and social subscriptions your licence is for personal use only. All Business and Enterprise subscriptions you may share assets with colleagues. Please see terms and conditions for more information on what you are allowed to do with your subscription.

Can I print downloaded photographs to use a canvas or frame?

You may if you hold a Busies or Enterprise subscription. This is also allowed for single purchases. All photos are high resolution excluding social subscription which is low res for social media. However, you may not re-sell the prints, these are for personal use only.

When will the watermark be removed?

For non-subscribers, the watermark will be removed once payment is made. For all subscribers the water mark will be removed once you download your chosen asset/s.

Do I own the asset exclusively once I pay for it?

No, we do not offer exclusive licences to any asset. If you want your own exclusive asset, please reach out to the team to organise a personal shoot, additional charges will apply.

Can I use an asset on behalf of a client?

If you are a business or enterprise subscriber, you may use your downloaded asset on behalf of a client. i.e. social media management, graphic designers etc. For non-subscribers and Social Subscribers your licence is for personal use only.

What is the Request Asset Feature and how does it work?

If you are a business or enterprise subscriber, you have access to request an asset. At the end of every month our team will create a list of requested assets and if possible, add this to our New Asset Monthly Shoot. The new assets will be added into the library the following month with business and enterprise subscribers getting first access to the new assets.

Will my requested asset be guaranteed in the next month’s New Assets? What if I need it before then?

Due to the large volume of requests, we cannot guarantee your chosen asset will appear in the next months New Assets. If you do require an asset before then please reach out to our team to organise a personal shoot, additional charges will apply.

What if I can’t find an asset I need?

For our business and enterprise subscribers you can use our Request Asset Feature. All other users can reach out to our team to organise a personal shoot to, if possible, obtain the asset you need. Additional Charges apply.

What happens if I want to cancel my subscription, can I still use the assets?

Once you cancel your subscription you will no longer have access to your download history so you will no longer be able to re download your assets. You may continue to use any asset you have previously downloaded to your device/computer after cancelling if you abide by the licence for the asset/s.

What are the differences between the 3 subscriptions?

Social Subscription intended for personal use on social media platforms, there is a monthly download limit of 10 assets. Business Subscription is intended for companies/businesses that need assets for multiple clients, prints, websites etc. There is a monthly download limit of 40 assets per week. Enterprise Subscription is intended for large scale Companies/Businesses that need assets for large scale campaigns, advertising, billboards etc There is a monthly download limit of 100 assets.

What is the difference between Nativ and a standard stock photo and video site?

Nativ Collection is a carefully curated library of high-quality photo and video assets from a localised part of southeast Queensland. It is the most extensive collection from this area that you will find anywhere. It is very simple and easy to use with no complicated licensing agreements or website to navigate. The collection is created and curated in house by a small team of professional videographers and photographers from this area.
